Terms of Service

Please read these Terms of Service ("Terms") carefully before using Elana Tales ("the Service"), operated by Elana Tales ("we", "us", "the Provider"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Elana Tales is a software-as-a-service platform that generates personalised, interactive audio adventures using artificial intelligence. Episodes, stories, audio files and related content ("Generated Content") are created dynamically by third-party AI providers on our behalf.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Service. By using the Service you represent that you meet this requirement.

3. Accounts

If you create an account you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately of any unauthorised use at team@elanatales.com.

4. Fees and Payment

Access to certain features requires a paid subscription. All fees are stated at the point of purchase and are payable in advance. Unless required by applicable law, fees are non-refundable.

Price changes. We may change subscription prices by giving you at least 30 days' written notice (by email or in-app notification). Price changes take effect at the start of the next billing period after the notice period ends. Continued use of the Service after a price change constitutes acceptance. We may need to adjust prices if our third-party provider costs increase, and we will always provide reasonable notice before doing so.

5. Generated Content

Generated Content is produced by third-party AI systems and is provided on an "as is" basis. We do not review, edit or endorse Generated Content and make no representation as to its accuracy, completeness, suitability or quality. You use Generated Content entirely at your own risk.

The Service is for entertainment purposes only. The LLMs used for dynamic content creation can make mistakes, occasionally generate low quality or nonsense text. None of the human-written or machne generated text is intended to represent real facts, events or people.

6. Acceptable Use

You must not:

• use the Service for any unlawful purpose;
• attempt to interfere with, disrupt, or gain unauthorised access to the Service;
• reverse-engineer, decompile, or extract source code from the Service;
• use the Service to generate or distribute harmful, abusive or illegal content;
• resell, sublicense or redistribute access to the Service without our written consent.

7. Availability and Third-Party Dependencies

We do not guarantee 100% uptime. The Service depends on third-party infrastructure, AI providers, cloud hosting and other external services. These third parties may experience downtime, errors, rate limits or service changes outside our control.

We will use commercially reasonable efforts to maintain availability but we expressly disclaim any warranty of uninterrupted, error-free or continuous service.

8. Intellectual Property

All rights in the Service, its design, code and branding remain with the Provider. Subject to these Terms, you retain any rights you may have in content you submit to the Service.

9. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, statutory or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy or reliability.

10. Limitation of Liability

Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under the laws of England and Wales.

Subject to the above, and to the maximum extent permitted by law:

• Liability cap. The Provider's total aggregate liability arising out of or in connection with these Terms or the Service, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total fees actually paid by you to the Provider in the one (1) month immediately preceding the event giving rise to the claim. If you are on a free plan, the Provider's total liability is limited to £10.
• Excluded losses. The Provider shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, business, savings, goodwill or data, regardless of whether such losses were foreseeable.

You acknowledge that the fees reflect the allocation of risk set out in these Terms and that the Provider would not enter into these Terms without these limitations.

11. Indemnification

You agree to indemnify and hold harmless the Provider, its officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your breach of these Terms, or your violation of any third-party rights.

12. Force Majeure

The Provider shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to: acts of God, fire, flood, pandemic, war, terrorism, civil unrest, government action, power or internet failure, failure of third-party services or providers, strikes or labour disputes.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time for any reason, including breach of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 5, 9, 10, 11, 12, 14 and 15 survive termination.

14. Changes to These Terms

We may update these Terms at any time. Material changes will be notified by email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, it shall be limited to the minimum extent necessary and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Provider regarding the Service.
